1.2 For residents based in the US, the Promoter is: Federici Brands LLC with offices at 195 Danbury Road, 3rd Floor, Wilton, Connecticut 06897.
1.3 This promotion is in no way endorsed, administered by, or associated with Meta
Platforms, Inc. (Facebook or Instagram). You agree to release Meta Platforms,
Inc. from any and all responsibility associated with the promotion. You
understand that you are providing your information to the Promotor and not to
Meta Platforms, Inc.
2. The promotion
2.1 The Promotor is running 12 separate promotions over 12 separate days with 12
separate brands as part of its 12 Days of Christmas Giveaways campaign. Entry
into one promotion does not constitute entry in any other promotion.
2.2 These terms and conditions relate to Day Twelve – Color Wow x Simmi.
2.3 This promotion is only open to residents in the UK and the US aged 18 or over,
except employees of the Promoter, their families, agents or any third party directly
associated with the administration of the promotion.
2.4 These terms and conditions apply to UK residents only. Participants resident in the US should refer to the terms and conditions applicable to US residents.
3. How to enter
3.1 The promotion will run from 12:00 PM GMT on 12 December 2024 (the "Opening Date") to 12:00 PM GMT on 13 December 2024 (the "Closing Date") inclusive.
3.2 All promotion entries must be received by the Promoter by no later than 11:59 AM on the Closing Date. All promotion entries received after the Closing Date are
automatically disqualified.
3.3 To enter the promotion, participants must:
(a) like the Promotor’s Instagram post that relates to promotion (the ‘‘Post’’);
(b) follow @colorwowhair and @simmilondon on Instagram; and
(c) tag someone in the comments section of the Post.
3.4 Share the Post to your Instagram story for an additional entry into the promotion.
3.5 This promotion is free to enter. No purchase is necessary.
3.6 The Promoter will not accept responsibility for promotion entries that are lost,
mislaid or delayed, regardless of cause, including, for example, as a result of any
equipment failure, technical malfunction, systems, satellite, network, server,
computer hardware or software failure of any kind.
3.7 By submitting a promotion entry, you are agreeing to be bound by these terms and conditions.
4. Eligibility
4.1 In entering the promotion, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are
eligible to enter the promotion.
4.2 The Promoter accepts no responsibility for entries not successfully completed due to a technical fault of any kind. The Promotor accepts no responsibility for any
purchases which are not completed for any reason.
4.3 Save as provided by clause 3.4 above, there is a limit of one entry to the promotion per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
4.4 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize promotion.
5. The prize
5.1 The prize comprises the following selection of Color Wow and Simmi products:

- £200 Simmi voucher
5.2 There is no cash alternative for the prize. The Promoter reserves the right to
substitute the prize with a prize of equal or greater value.
5.3 SIMMI UK Limited (‘‘Simmi’’) will supply the Simmi voucher as part of the prize. The Promoter will supply the Color Wow products as part of the prize. Simmi will
deliver the prize. The Promoter reserves the right to replace the prize with an
alternative prize of equal or higher value if circumstances beyond the Promoter's
control makes it necessary to do so.
5.4 The prize is not negotiable.
6. Winners
6.1 One winner will be selected by random draw performed by a computer process on 13 December 2024 (‘‘Draw date’’).
6.2 the Promoter will contact the winner via direct message on Instagram within five
days after the Draw Date. The Promoter shall have no liability for a winner’s
failure to receive notices due to a winner’s spam, junk e-mail or other security
settings or for winner’s provision of incorrect or otherwise non-functioning contact
information.
6.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners to anyone who emails cs
uk@colorwowhair.com or writes to the Promotor at 22 Chancery Lane, London,
England, WC2A 1LS (enclosing a self-addressed envelope) within one month
after the Closing Date of the promotion.
6.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at cs-
uk@colorwowhair.com or 22 Chancery Lane, London, England, WC2A 1LS. In
such circumstances, the Promoter must still provide the information and winning
entry to the Advertising Standards Authority on request.
7. Claiming the prize
7.1 A winner must respond to the Promotor’s direct message on Instagram and provide a postal address to claim their prize. If a winner does not respond to the Promotor within 15 days of being notified by the Promoter, then the winner’s prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.
7.2 The prize will be sent to the winner by post within 14 of days of confirmation of the winner’s postal address.
7.3 The prize may not be claimed by a third party on your behalf.
8. Limitation of liability
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any
circumstances be responsible or liable to compensate the winner or accept any
liability for any loss, damage, personal injury or death occurring as a result of
taking up the prize except where it is caused by the negligence of the Promoter,
its agents or distributors or that of their employees. Your statutory rights are not
affected.
9. Ownership of promotion entries and intellectual property rights
9.1 All promotion entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
9.2 By submitting your promotion entry and any accompanying material, you agree to:
(a) assign absolutely to the Promoter all your intellectual property rights held in
the promotion entry with full title guarantee; and
(b) waive absolutely all moral rights,
in and to your promotion entry and otherwise arising in connection with your entry
to which you may now or at any time in the future be entitled under the Copyright,
Designs and Patents Act 1988 as amended from time to time and under all similar
legislation from time to time in force anywhere in the world.
9.3 You agree that the Promoter may, in their sole discretion, make your entry available on its website and in any other media, whether now known or invented in the future, and in connection with any publicity of the promotion. You grant the
Promoter a non-exclusive, worldwide, irrevocable licence in perpetuity, for the full
period of the intellectual property rights in the promotion entry and any
accompanying materials, to use, display, publish, transmit, copy, edit, alter, store,
re-format and sub-licence the intellectual property rights in the promotion entry
and any accompanying materials for such purposes.
10. Data protection and publicity
10.1 The Promoter will only process your personal information as set out in the

11. General
11.1 If there is any reason to believe that there has been a breach of these terms andconditions, the Promoter may, at its sole discretion, reserve the right to exclude
you from participating in the promotion.
11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize promotion where it becomes necessary to do so.
11.3 These terms and conditions are governed by English law. If any entrants to this
promotion wish to take court proceedings, then they must do this within the courts

5.2 There is no cash alternative for the prize. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.
5.3 Elemis Ltd (‘‘Elemis’’) will supply Elemis products as part of the prize. The Promoter will supply the Color Wow products as part of the prize. Elemis will deliver the prize. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.
