Color Wow Subscriptions (“Color Wow Subscriptions”) is an auto-renewal subscription service that allows you to automatically receive repeating shipments of your choice of eligible products, indicated on the Website, at an interval you choose. The following terms and conditions ("Subscription Terms") apply to Color Wow Subscriptions, available on our website, www.uk.colorwowhair.com (the “Website”). 

As used in these Subscription Terms, “Color Wow,” “we,” “us,” and “our" refer to Federici Brands Ltd, which owns and controls the brands Color Wow and Curl Wow. We provide our services to you (“you,” “your”, or "Customer") subject to these Subscription Terms. Additionally, your use of the Website, including Subscriptions, is governed by our Terms & Conditions and Privacy Notice.

To enroll in Color Wow Subscriptions, we require your affirmative consent at checkout before we process your order or have your provided payment method charged in connection with any Color Wow Subscriptions purchase. By checking the indicated consent check box on our Website before checkout, you indicate your acceptance of these Subscription Terms.

Color Wow Subscriptions Overview

Color Wow Subscriptions is an auto-renewal subscription program that allows you to automatically receive repeating shipments of your choice of eligible products, indicated on the Website, at an interval you choose. 

Enrollment in Color Wow Subscriptions is open to Website customers 18 years of age or older, subject to any exceptions set forth in these Subscription Terms. There is no cost or fee associated with the Color Wow Subscriptions service for customers who add eligible items to their carts.

    • Additional gifts every third delivery cycle thereafter

Eligible Products

Color Wow Subscriptions is available for select products that we sell on the Website. A product’s eligibility for Color Wow Subscriptions will be displayed on the Color Wow Subscriptions Collection page, the eligible item’s product page, and on the checkout page when eligible products are included. Product eligibility, including free products with every third delivery, is subject to change, and we reserve the right to add or remove products from the Color Wow Subscriptions program at our sole discretion. 

Free Shipping

We offer free shipping for Color Wow Subscriptions orders. Please see our standard Shipping Policy for more details.

Please note that, in some cases, product availability may affect when your Color Wow Subscriptions products ship and therefore affect delivery timing. Estimated delivery dates may also be affected by circumstances or conditions beyond our reasonable control. Whenever possible, we will notify you as soon as practicable if we anticipate a delay in your expected subscription delivery. Please see our standard Shipping Policy for more details.

Color Wow Subscriptions Limitations

We reserve the right to accept, decline, or cancel any Color Wow Subscriptions at our sole discretion. Color Wow Subscriptions cannot be transferred or assigned, nor can any other Color Wow Subscriptions program benefits be resold to others. Certain promotions cannot be applied to Color Wow Subscriptions orders. Please review exclusions or restrictions with any Color Wow coupon, promotion, or other benefit.

Automatic Renewal

COLOR WOW SUBSCRIPTIONS IS AN AUTO-RENEWAL SUBSCRIPTION PROGRAM. YOUR SUBSCRIPTION TO THE PRODUCTS YOU SELECT WILL RENEW AUTOMATICALLY AT YOUR CHOSEN INTERVAL AND AT THE PRICE IDENTIFIED AT CHECKOUT, OR AS OTHERWISE PROVIDED TO YOU IN A SUBSEQUENT NOTICE SHOULD SUCH PRICE CHANGE, AND YOUR METHOD OF PAYMENT ON FILE WITH US WILL BE CHARGED. YOUR SUBSCRIPTION TO COLOR WOW SUBSCRIPTIONS WILL CONTINUE UNTIL YOU CANCEL OR OTHERWISE MODIFY IT. Payment, Billing, and Credit Card Authorization

By using the Color Wow Subscriptions service, you authorize us to charge the price stated at the time you place your subscription order to your selected payment method automatically and on a recurring basis at the interval you select for each scheduled shipment unless and until you change or cancel your Color Wow Subscription as provided in these Subscription Terms. 

You must follow the “Manage Your Subscriptions” link as described below in “Managing and Cancelling Your Subscription” to view the last date you can cancel or otherwise modify your subscription to avoid being charged for the next recurring order. All charges are subject to applicable taxes.

Your subscription requires a valid payment method. If none is on file or the current payment method is no longer valid, your subscription will be paused and your subscription orders will be skipped until you update your payment method. You may update or change your payment method by following the “Manage Your Subscriptions” link on our Website, on the Color Wow Subscriptions Collection page, or through your Color Wow Customer Account.          

Changes to Product Prices

If the price for any of your Color Wow Subscription products increases, we will notify you by email and you will have the opportunity to cancel or modify your subscription, either completely or for individual products, before we process your next recurring order or have your indicated method of payment charged.

Managing and Canceling Your Subscription

You can manage or cancel your subscription any time by clicking the “MANAGE YOUR SUBSCRIPTIONS” button to access our Color Wow Subscriptions Collection page on the Website. On that page, you can update your delivery schedule, change the eligible product selections or quantity, pause your subscription, or cancel your subscription.

To access the "MANAGE YOUR SUBSCRIPTIONS" button, simply click on the Color Wow Customer Account Page icon on the top right of the Website or click here. Account holders can log in using your Color Wow account email and password. Alternatively, for account holders or non-account holders, you can click the "MANAGE YOUR SUBSCRIPTIONS" button on the login page and enter the email address or phone number that you used when subscribing, which is linked to your Shopify checkout profile. You will receive a 4-digit unique, one-time login code either by email or SMS text message. Please enter the code where indicated, and once the code is verified, you will be able to view and manage your Color Wow Subscriptions. If you wish to revisit the subscriptions management options at a later time, you will need to repeat this process to obtain another unique, one-time login code.

TO CANCEL OR OTHERWISE MANAGE A COLOR WOW SUBSCRIPTION, YOU MUST COMPLETE THE CANCELLATION/MANAGEMENT PROCESS NO LESS THAN ONE (1) DAY BEFORE THE DEADLINE STATED IN THE REMINDER EMAIL THAT WE SEND FIVE (5) DAYS BEFORE YOUR SUBSCRIPTION AUTOMATICALLY RENEWS. OTHERWISE, YOUR SUBSCRIPTION ORDER WILL AUTOMATICALLY BE PROCESSED AND YOUR PAYMENT METHOD WILL BE CHARGED. 

As an example of the cancellation policy above: If you subscribe on July 15th for monthly delivery of eligible products, you have until 11:59pm GMT on August 14th to cancel or otherwise modify your subscriptions. If you do not cancel or modify by that date and time, then your Color Wow Subscriptions will automatically renew for another month, and you will have until 11:59pm GMT on the 14th day of each subsequent month to cancel or modify your subscription. 

  • To cancel your subscription:

    • Access the Color Wow Customer Account page here, and follow the steps explained above in this section to access your subscriptions      

    • Click the “Cancel” button     

    • Select the products you would like to cancel from your Color Wow Subscriptions

    • You will receive an email from us confirming that your requested cancellation was successful

    • If you do not receive an email confirming that your cancellation was successful, please contact us at cs-uk@colorwowhair.com.

  • To manage your subscription:

    • “Skip” – To skip the next scheduled delivery and resume delivery for the following processing/billing cycle

    • “Edit Products” – To add or remove products or quantities from your subscription

    • “Edit Frequency” – To change how often your subscription products will be delivered (every one, two, or three months)

    • “Pause” - To temporarily pause your subscription for one, two, or three months

    • “Reactivate” – To restart your subscription after pausing or cancelling it

    • Access the Color Wow Customer Account page here, and follow the steps explained above in this section to access your subscriptions.      

    • Select the products or delivery options you would like to manage in your Color Wow Subscriptions

    • Choose among the following options to manage your subscription:

Changes to Color Wow Subscriptions Service

Color Wow reserves the right to modify or change these Subscription Terms, as well as the benefits, terms, eligible products, or availability of the Color Wow Subscriptions program at any time, in its sole discretion. Updated Subscription Terms reflecting any changes or modifications will be displayed on the Website and will be effective upon posting on website. If any change to these Subscription Terms is determined to be invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or updated terms or conditions. BY CONTINUING YOUR COLOR WOW SUBSCRIPTIONS FOLLOWING CHANGES TO THESE SUBSCRIPTION TERMS, YOU INDICATE AND ACKNOWLEDGE YOUR ACCEPTANCE OF THE CHANGES. YOU MUST CANCEL YOUR SUBSCRIPTION IF YOU DO NOT ACCEPT SUCH CHANGES.

Returns and Refunds

Color Wow Subscriptions orders follow Color Wow’s standard refund policy. For details, visit our Refund Policy. 

Termination of Your Color Wow Subscriptions

We may suspend or cancel your subscription to Color Wow Subscriptions at any time for any reason. If we suspend or cancel your subscription, you will only be charged for orders that have already shipped or are processing.

Limitation of Liability

YOU UNDERSTAND, ACKNOWLEDGE, AND AGREE THAT YOUR PARTICIPATION AND USE OF COLOR WOW SUBSCRIPTIONS IS AT YOUR OWN RISK. IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN COLOR WOW’S TERMS OF USE, AND TO THE FULLEST EXTENT PROVIDED UNDER APPLICABLE LAW, COLOR WOW SHALL NOT BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, LOST REVENUES OR LOST PROFITS, IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THIS COLOR WOW SUBSCRIPTIONS SUBSCRIPTION. COLOR WOW’S TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE TOTAL VALUE OF PURCHASES MADE UNDER THE COLOR WOW SUBSCRIPTIONS PROGRAM IN THE PREVIOUS TWELVE (12) MONTHS. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR COLOR WOW SUBSCRIPTIONS. 

NOTHING IN THESE SUBSCRIPTION TERMS EXCLUDES COLOR WOW'S LIABILITY IN REPECT OF DEATH OR PERSONAL INJURY CAUSED BY COLOR WOW'S NEGLIGENCE, FRAUD, BREACH OF TERMS IMPLIED BY SECTION 12 OF THE SALES OF GOODS ACT 1979, OR LIABILITY FOR DEFECTIVE PRODUCTS UNDER THE CONSUMER PROTECTION ACT 1987.

Indemnification

You agree to indemnify, defend, and hold harmless Color Wow and its representatives, employees, and agents harmless from and against any and all third-party claims, demands, liabilities, costs, or expenses, including reasonable attorney’s fees and costs, arising from, or related to, any breach by you of any Subscription Terms or any violation by you of applicable law.

Governing Law and Jurisdiction

THIS AGREEMENT SHALL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF ENGLAND AND WALES. COLOR WOW AND THE CUSTOMER AGREE THAT THE COURTS OF ENGLAND AND WALES SHALL HAVE EXCLUSIVE JURISDICTION TO SETTLE ANY DISPUTE OR CLAIM (INCLUDING NON-CONTRACTUAL DISPUTES OR CLAIMS) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR ITS SUBJECT MATTER OR FORMATION.  

No Waiver

Any inaction or failure to insist upon or enforce your strict compliance with these Subscription Terms shall not constitute a waiver of any of our rights.

Severability

If any provision of these Subscription Terms is found to be contrary to law, the remainder of that provision (if any) and the remaining provisions of these Subscription Terms will remain in full force and effect.

Entire Subscription Terms

These Subscription Terms shall, as the same may be amended from time to time, constitute the complete and exclusive agreement between Color Wow and Customer with respect to the subject matter hereof. It supersedes and replaces all prior discussions, negotiations, understandings and agreements, written and oral, regarding such matters. Any additional or different terms in any purchase order or other written or oral response by Customer shall be deemed rejected by Color Wow without need of further notice and shall not be part of these Subscription Terms or in any way binding upon Color Wow.
